Commercial yachts must comply with specific requirements, including:
Certification in accordance with the applicable Commercial Yacht Code
Compliance with safety, manning, and operational standards
Restrictions on the number of passengers and operational scope
Ongoing surveys and inspections to maintain certification
Depending on the size and type of vessel, yachts may fall under the Small Commercial Yacht Code or the Large Yacht Code, each prescribing distinct regulatory and certification requirements.
The classification between private and commercial use has direct implications on VAT treatment, compliance obligations, and operational flexibility, and should therefore be carefully assessed at structuring stage.
